Magistrates’ Court of Western Australia

The Local Court is the lowest Court in the state legal system and the busiest. Almost all criminal matters commence in the Magistrates’ Court and the majority are finished in that Court. Committal proceedings are also conducted for offences which must be heard in the District and Supreme Courts.

Offences which are described as "simple offences" are always finalised in the Magistrates’ Court. Offences which are described as “crimes” are called indictable offences and must be heard in the District Court or the Supreme Court unless the relevant legislation states that there is a “summary penalty” for the crime. If there is a stated “summary penalty” that crime can be finalised in the Magistrates’ Court.

The penalties the Local Court can impose in criminal matters include Conditional Release Orders, fines, Community Based Orders, Intensive Supervision Orders and imprisonment.
